All payments for the services will be processed by our third party vendor, PayPal.
If You have a paid membership, Your credit card or PayPal will be automatically charged each month for monthly subscription or each year for yearly subscription until You cancel the services. For avoidance of doubt, Your credit card will continue to be charged if You fail to cancel Your membership and such amounts will not be refundable to You.
Subscription Fees are paid in advance for subsequent Billing Cycles.
The Account Parameters may be changed at any time after the selection of the Subscription Plan.
When You submit your credit card information, it is processed by PayPal and not Us. We do not have access to, retain or store the personal information (including your credit card information) submitted during the payment process. WE ASSUME NO RESPONSIBILITY FOR YOUR USE OF ANY PAYMENT PROCESSING SYSTEM PROVIDED BY PAYPAL. WE DO NOT GUARANTEE THE SECURITY OF YOUR INFORMATION WHEN PROCESSED BY PAYPAL.
We have the right to change business model (monthly fees, account types etc.) and will use good faith efforts to notify you prior to the effectiveness of any significant change.
JURISDICTION AND APPLICABLE LAW
- We may terminate Your membership at any time upon notice to You by email.
- If You terminate this Agreement You will not be refunded for any credits or previously paid fees.
- You may terminate Your paid membership at any time. You acknowledge that cancelling your paid membership does not delete Your account, but also no downgrades it to a free membership.
- You acknowledge that termination of a paid membership takes two (2) weeks to process. If You terminate a paid membership after the 15th day of the month, Your credit card or PayPal account will be charged the amount due for the following month.
The English courts will have non-exclusive jurisdiction over any claim arising from, or related to, a visit to our site or mobile application.
CLAIMS AND COMPLAINTS
The complaint letter should contain: name and surname - in the case of a natural person or the business name - in the case of a legal person or an organizational unit other than a legal person, however recognized as having legal personality under the Act. Also, the letter should contain the Users Username/Email address, the exact address of seat or residence, optionally the mailing address, should it be different from the address of seat or residence, the email address provided during the Registration, and a detailed description and reason of the complaint
We shall consider the complaint within 7 business days from the date of its reception and shall immediately inform the User by e-mail as to how it is to be dealt with. Should the information given in the complaint letter require further supplementation, the Operator shall request so prior to move to the complaint consideration. The time required by the User to provide the supplementary information shall accordingly extend the complaint processing period.
We are entitled to temporary downtime in the operation of the Site or mobile application and breaks in provision of the Services due to technical reasons.
We shall make every effort for the technical breaks to occur at night and as shortly as possible.
For any technical break lasting in excess of 24 hours at a time, the Account Owner shall have the right to apply to the Operator, using the procedures described in item VIII below, with a request to extend the Billing Cycle, during which the technical break occurred, by the same period as the downtime lasted.
USERS' ACCOUNT CONTENT (Collections, Links, Images etc.)
We may immediately disable your access to the site and mobile application or remove all or a portion of your content, without warning and/or refund, if we believe that the content may be deemed as defamatory, libelous, obscene, harassing, threatening, incendiary, abusive, racist, offensive, deceptive or fraudulent, encouraging criminal or harmful conduct, or which otherwise violates the rights of Wix or any third party (including any intellectual property rights, privacy rights, contractual or fiduciary rights), or otherwise shows any person, entity or brand in a bad or disparaging light, without their prior explicit approval.
LOGO AND NAME USAGE
We may use Customer logo and name within sales and marketing material, including material on the website www.LinkXEE.com. Customer also agrees to provide a case study and testimonials.
